1Agreement to terms

These Terms & Conditions ("Terms") govern your access to https://devkrest.com and your use of custom software development, web, mobile, AI, CRM, and product engineering services provided by Devkrest Technologies ("Devkrest", "we", "us", or "our").

By visiting our website, submitting an inquiry, signing a proposal, or engaging our team, you agree to be bound by these Terms together with our Privacy Policy and Refund & Cancellation Policy.

2Services

Devkrest provides bespoke software consultancy and delivery services, including discovery, design, development, testing, deployment, and ongoing support as defined in individual statements of work, proposals, or master service agreements.

Service scope, timelines, deliverables, and pricing are confirmed in writing for each engagement. Any work outside the agreed scope may require a change request and additional fees.

3Client obligations

• Provide accurate project requirements, content, credentials, and timely feedback
• Assign a point of contact with authority to approve milestones and deliverables
• Ensure you have rights to any materials, data, or third-party assets you supply
• Make payments according to the schedule in your service agreement
• Use delivered software lawfully and in compliance with applicable regulations

4Intellectual property

Unless otherwise stated in a signed project contract, all intellectual property rights in custom code, mobile applications, web applications, and software builds developed specifically for you shall transfer to and remain the property of the client upon complete settlement of all invoices and milestone payments due under that engagement.

Devkrest retains ownership of its pre-existing tools, libraries, frameworks, methodologies, and general know-how. We grant clients a license to use any such components embedded in deliverables as needed to operate the delivered solution.

Devkrest may display non-confidential project work in portfolios, case studies, or marketing materials unless a written NDA or contract expressly restricts this.

5Payment and billing

Fees, milestone schedules, and payment methods are defined in your proposal or service agreement. Unless stated otherwise, invoices are payable as per the agreed milestone or sprint cycle.

Late payments may pause work, withhold deliverables, or incur interest as permitted by law and stated in your contract. Taxes, gateway charges, and currency conversion costs are the client's responsibility where applicable.

6Confidentiality

Both parties agree to protect confidential business, technical, and financial information shared during an engagement. Confidentiality obligations survive termination except for information that becomes public through no fault of the receiving party or is required to be disclosed by law.

7Warranties and disclaimers

Devkrest warrants that services will be performed with reasonable skill and care consistent with industry standards. Except as expressly stated in a signed agreement, services are provided on an "as is" basis after delivery and acceptance.

We do not warrant uninterrupted operation of third-party platforms, hosting providers, app stores, or payment gateways integrated into your solution.

8Limitation of liability

To the fullest extent permitted by law, Devkrest shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity.

Our total liability arising from any engagement shall not exceed the fees paid by the client to Devkrest for that engagement in the three months preceding the claim, unless a higher cap is expressly stated in a signed contract.

9Termination

Either party may terminate an engagement as set out in the applicable service agreement. Termination does not relieve the client of payment obligations for work completed, active sprints, or accepted milestones. Refund treatment is governed by our Refund & Cancellation Policy.

10Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms or Devkrest services shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
